What rights do nursing home residents have?

 

A: The Medicare program requires nursing homes receiving funding to be free from verbal, sexual, physical and mental abuse, and any physical or chemical restraint that is imposed for purposes of discipline or convenience, rather than to treat a medical condition.  In some instances, due to a medical condition, restraint may be used upon written order of a physician.  In that situation, the doctor must specify the duration and circumstances under which the restraints are to be used.  

If a nursing home isn't regulated by the medicare program, residents will still have rights under state laws.
