
A New York truck driver has been convicted of three counts of vehicular manslaughter by a judge who said that although they cannot prove that the man was under the influence of drugs at the time of the fatal truck accident, they could certainly prove that the trucker acted recklessly and was ultimately responsible for the accident.
On September 11, 2008, 42-year-old Sheraz Khan of New York was driving a tractor-trailer loaded with heavy machinery on Interstate 295 north. The big rig suddenly drifted across traffic, drove across the median and struck a small car and a box truck. The truck accident instantly killed two people inside the box truck, 44-year-old Juma Rajab and 44-year-old Renee Lesenko, as well as the driver of the VW Beetle, 66-year-old Lawrence Wright.
Witnesses to the truck accident said that they believe that the trucker had fallen asleep at the wheel based on the way the truck drifted off of the road. Police who interviewed Khan immediately after the truck accident said that he did not seem to have an elevated pulse or to have reacted to the crash – and that he seemed to drift off to sleep while talking. They later found that Khan had falsified his trucker log and that he did not have the correct medical credentials. In addition, the trucker tested positive for marijuana and illegal steroids in the hours after the crash.
When the crash occurred, the trucker asked police to go back to his cab to get a bottle of water. Police didn’t find water, but did find a bottle of illegal steroids, marijuana, and marijuana pipes.
