Two Families Settle Wrongful Death Lawsuits After NY Plane Crash

The families of two New York plane accident victims have settled their wrongful death lawsuits privately with the airliner responsible for the February 2009 airplane crash that killed 50 people.

The families of John G. Roberts III and Darren Tolsma are just two of dozens of people who are suing the airline and the airplane manufacturer in the wake of the deadly plane crash that occurred outside of Buffalo, New York. While these two families have taken a settlement, others are holding out for a better settlement or their day in court.

The plane accident took place on a snowy day during a commute between Newark and Buffalo, New York – Colgan Air Flight 3407. In the investigation that followed the accident, officials agreed that the pilot made several deadly errors and that fatigue and poor work conditions likely played a part in the crash.

The aircraft was piloted by 47-year-old Marvin Renslow and copiloted by 24-year-old Rebecca Shaw – both of whom commuted to their airport from other cities and both of whom where paid a shockingly low wage. In 2008, Shaw made just $16,000. During the flight, ice built up on the wings and landing gear, causing some concern for the pilots. During the de-icing process, the plane lost significant speed and stalled. The pilot did not do either of the correct actions at this time: he neither pointed the nose of the plane down or increased the speed of the plane as much as possible.

The plane crashed into a residential home, killing one person inside.
